1. Acceptance of Terms
By registering a workspace on BlinkBill ("the Service"), you ("the User") confirm that you have read, understood, and unconditionally agree to be bound by these Terms of Service. If you do not agree, you must not register or use the Service.
2. Nature of Service
BlinkBill is a cloud-based point-of-sale software tool designed to assist retail businesses with billing, inventory tracking, and record-keeping. It is a business management aid only. BlinkBill does not provide accounting, legal, tax, or financial advisory services. No information generated by this software constitutes professional advice of any kind.
3. No Warranty — "As Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
BlinkBill does not warrant that:
- The Service will be uninterrupted, error-free, or secure at all times
- Any data stored will be free from loss, corruption, or unauthorised access
- The Service will meet your specific business requirements
- Any errors or bugs will be corrected within a specific timeframe
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLINKBILL, ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- Loss of business, revenue, profits, or anticipated savings
- Loss of data or inability to recover data
- Indirect, incidental, special, or consequential damages
- Errors in bills, invoices, tax calculations, or GST filings generated using this software
- Financial losses resulting from reliance on data produced by the Service
- Downtime, service interruptions, or data unavailability
You assume full responsibility for verifying the accuracy of all bills, calculations, and reports generated by the Service before using them for any legal, financial, or tax purpose.
5. User Responsibilities
You are solely responsible for:
- Maintaining the confidentiality of your workspace credentials
- All activities that occur under your workspace
- Ensuring your use of the Service complies with all applicable Indian laws, including GST regulations, the Information Technology Act 2000, and any applicable tax laws
- Taking regular backups of data critical to your business
- Any bills, invoices, or receipts issued to your customers using this software
6. Data & Privacy
Your workspace data (bills, products, customer records) is stored in Google Firebase Firestore under your unique workspace ID. BlinkBill will not sell, share, or disclose your business data to third parties except as required by law. However, BlinkBill cannot guarantee absolute security against all forms of unauthorised access.
7. Subscription & Payments
Free trial workspaces are provided for evaluation purposes for the stated trial period. After the trial, continued access requires a paid subscription. Subscription fees are non-refundable once a workspace has been activated and data has been written to it. Payments are processed securely via Razorpay; BlinkBill does not store your card or payment details.
8. Prohibited Use
You may not use the Service to generate fraudulent invoices, evade taxes, launder money, or for any activity that violates applicable law. BlinkBill reserves the right to suspend or terminate any workspace found to be in violation of this clause without notice or refund.
9. Service Modifications & Termination
BlinkBill reserves the right to modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.
11. Entire Agreement
These Terms constitute the entire agreement between you and BlinkBill regarding your use of the Service and supersede all prior agreements, understandings, or representations. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
